Spence lawsuit over Instagram post revived by judge

The Spence School is facing a revived lawsuit over their response to an offensive Instagram post from a student.

Adam and Michelle Parker sued the tony Upper East Side all girls private school back in 2019 after their daughter was singled out for punishment after she posted a screenshots of a chat to Instagram of her joking about potentially dressing up as slaves or Hitler for Halloween.

The suit was tossed in 2020, but on Thursday a New York appeals court resuscitated the complaint over breach of contract on the grounds that Spence might have failed to adhere to their own protocols when punishing the Parker’s daughter.

“Spence will continue to vigorously defend the single remaining contract issue in the case, as it properly followed its procedures in finding that a half-day of home reflection was an appropriate educational remedy here,” the school said in a statement to Bloomberg.
